The LYNQr Pulse beta exists to verify three things and three things only: extraction accuracy (do the quantities and schedules pulled from Archicad match what is actually in your model), stability (does Pulse install, connect, sync, and run reliably across real machines and projects without crashing or failing silently), and schedule fidelity (do the schedules routed to the dashboard reflect your LYNQr properties as authored, with correct gating, ordering, and write-back). The single question every beta firm is helping answer is: when LYNQr says this is what is in your building, is it right, every time.
This beta is not a feature-request intake, a roadmap vote, or a design review. New tabs, new disciplines, new dashboard interactions, pricing opinions, and “could it also do X” requests are out of scope for the test window. They are welcome through the in-app Feedback tool and will be considered after the beta, not actioned during it. The terms below exist because this is an evaluation of pre-release software, and they keep that evaluation safe for both sides.
By accepting this agreement and accessing LYNQr Pulse, you (the “Participant”) agree to the following terms with Link, Inc., an Idaho corporation doing business as LYNQr (“LYNQr”).
LYNQr grants the Participant a limited, non-exclusive, non-transferable, revocable right to use LYNQr Pulse and the associated dashboard for internal evaluation during the beta period. Access may be granted per named user (seat) and may not be shared, resold, or transferred. LYNQr may modify, suspend, or withdraw any feature at any time during the beta.
LYNQr Pulse is pre-release software provided for evaluation. The Participant agrees not to rely on its output for production purposes. Any quantity, schedule, or other data produced by LYNQr Pulse must be independently verified by the Participant before it is used in a bid, purchase order, construction document, client deliverable, or any other decision involving cost, schedule, or contractual obligation. LYNQr is not responsible for any decision made in reliance on beta output.
LYNQr Pulse, the dashboard, pricing, roadmap, and all non-public behavior, performance, and design of the software are confidential. The Participant agrees not to disclose, share, screenshot, demonstrate, benchmark publicly, publish, or otherwise publicize any part of the beta, or the Participant’s participation in it, without LYNQr’s prior written consent. The Participant will limit internal access to those staff who need it for the evaluation and who are bound by equivalent confidentiality obligations.
LYNQr Pulse is provided “as is” and “as available,” without warranty of any kind, whether express, implied, or statutory. LYNQr expressly disclaims all implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. The Participant acknowledges that beta software may contain defects, may be interrupted, and may produce incomplete or incorrect results.
The Participant knowingly accepts the risks of using pre-release software, including the risk of inaccurate extraction results, data loss, downtime, and interruption to its own workflows. The Participant is responsible for maintaining its own backups of its Archicad models and project data.
To the maximum extent permitted by law, LYNQr and Link, Inc. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, lost data, or business interruption, arising out of or related to the beta. LYNQr’s total aggregate liability arising out of or related to this agreement and the beta will not exceed one hundred U.S. dollars (US $100). Because the beta is provided at no charge, the Participant agrees this limitation is reasonable.
LYNQr will access the Participant’s Archicad models and extracted project data only as needed to operate the software and to evaluate and improve it during the beta. LYNQr will not sell the Participant’s project data. LYNQr may use anonymized or aggregated data derived from beta usage to improve its products. On termination, the Participant may request deletion of its tenant data, and LYNQr will delete it within a reasonable period except where retention is required by law or for backup integrity.
Any feedback, suggestions, bug reports, or ideas the Participant provides are given freely and become the property of LYNQr. LYNQr may use them for any purpose, including building them into the product, without obligation, compensation, attribution, or any claim by the Participant. The Participant retains ownership of its own underlying project data and intellectual property.
This agreement applies for the duration of the beta period and any extension communicated by LYNQr. Either party may end the Participant’s involvement at any time, for any reason, on written notice. LYNQr may suspend or revoke access immediately if these terms are breached. The confidentiality, no-warranty, assumption-of-risk, limitation-of-liability, and feedback sections survive termination.
This agreement is governed by the laws of the State of Idaho, without regard to its conflict-of-laws rules. The parties consent to the exclusive jurisdiction of the state and federal courts located in Idaho for any dispute arising out of or related to this agreement.
This agreement is the entire understanding between the parties regarding the beta and supersedes any prior discussions. If any provision is found unenforceable, the rest remains in effect. LYNQr may update these terms during the beta on written notice, and continued use after notice constitutes acceptance.
