By accessing or using LYNQr (getlynqr.com), including LYNQr Pulse and any related services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you are using the Service on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.
If you do not agree to these Terms, do not use the Service.
LYNQr is a building intelligence extraction platform that connects architectural design software (including Graphisoft Archicad) to live project dashboards. The Service enables users to extract, organize, and analyze building data including furniture, fixtures, equipment schedules, and other building element data.
LYNQr is operated by Link, Inc., an Idaho corporation (DBA LYNQr), located in Idaho, United States.
3.1 Registration.
To use the Service, you must register and receive an API key. You are responsible for maintaining the security of your API key and all activity that occurs under your account.
3.2 Accurate Information.
You agree to provide accurate information during registration and to keep it current.
3.3 API Key Security.
Your API key is the credential that identifies your account. Do not share it. If you believe your key has been compromised, use the key rotation feature in your account settings immediately and contact us at support@getlynqr.com.
3.4 Eligibility.
You must be at least 18 years old to use the Service. By using LYNQr, you represent that you meet this requirement.
3.5 Notices.
We may send notices to you at the email address associated with your account. You are responsible for keeping your email address current. Notices sent to your email address on file are deemed received whether or not you actually receive them. To send a legal notice to Link, Inc., email support@getlynqr.com with the subject line “Legal Notice.”
3.6 Firm Accounts and Administration.
If your subscription covers multiple seats within a firm, the individual who creates the account or is designated during onboarding is the Firm Administrator. The Firm Administrator is responsible for managing user access, assigning and removing seats, and ensuring all users within the firm comply with these Terms.
3.7 Administrator Changes.
If the Firm Administrator is no longer authorized to manage the account (due to departure, role change, or other reason), the firm must designate a new Firm Administrator by contacting support@getlynqr.com. Until a new administrator is designated, the existing administrator’s access and authority remain in effect. Link, Inc. may require reasonable verification of authority before transferring administrative control.
3.8 Seat Removal.
A Firm Administrator may remove a user’s seat from the firm account at any time. Removing a seat does not automatically delete that user’s contributions to shared project data. Requests to delete specific user data within a firm account must be submitted to support@getlynqr.com and may require authorization from both the Firm Administrator and the affected user where required by applicable law.
4.1 Plans.
LYNQr offers subscription plans billed on a monthly basis. Current pricing is listed at getlynqr.com/pricing.
4.2 Free Trial.
New accounts may be eligible for a 30-day free trial. At the end of the trial period, your account will require a paid subscription to continue accessing the Service. We reserve the right to modify or discontinue free trial offers at any time.
4.3 Billing.
Payments are processed by Stripe. By subscribing, you authorize Link, Inc. to charge your payment method on a recurring basis until you cancel.
4.4 Cancellation.
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial periods.
4.5 Price Changes.
We may change subscription pricing with 30 days notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.
4.6 Taxes.
You are responsible for any applicable taxes associated with your subscription.
4.7 Geographic Pricing.
Subscription pricing is determined by the country in which your business is legally registered, as provided during account creation. LYNQr does not use your IP address or physical location to determine applicable pricing tiers or regional rates. If your country of registration changes, you are responsible for updating your account information, and pricing adjustments will take effect at the start of the next billing cycle.
4.8 Auto-Renewal.
Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged using the payment method on file at the then-current subscription rate. You may cancel at any time through your account settings to prevent future renewals.
4.9 Refunds.
All subscription fees are non-refundable except where required by applicable law. If you believe a charge was made in error, contact us at support@getlynqr.com within 30 days of the charge and we will review your request.
4.10 Failed Payments.
If a scheduled payment fails, Stripe will automatically retry the charge according to its standard retry schedule. During the retry period, your access to the Service will continue uninterrupted. If payment remains unsuccessful after all retry attempts (typically 3 to 4 attempts over approximately 2 weeks), your account will be moved to a suspended state.
4.11 Suspension for Non-Payment.
While suspended, your account will be placed in read-only mode. You will be able to log in and view your data but will not be able to sync, edit, or use active features of the Service. You will receive an email notification when your account is suspended. If payment is not resolved within 30 days of suspension, your account will be terminated and the data retention period described in Section 6.5 will begin. You may resolve a suspended account at any time by updating your payment method in your account settings.
You agree not to:
Link, Inc. reserves the right to throttle, limit, or suspend access for any account whose usage places an unreasonable burden on the Service’s infrastructure, as determined at Link, Inc.’s sole discretion. This includes but is not limited to automated scripts or processes that generate excessive API requests.
6.1 Ownership.
You retain all ownership rights to the building data, project data, and other content you submit to the Service (“Your Data”).
6.2 License to Operate.
By using the Service, you grant Link, Inc. a limited, non-exclusive license to store, process, and display Your Data solely as necessary to provide the Service to you.
6.3 Tenant Isolation.
We implement reasonable technical measures to logically separate Your Data from other subscribers’ data. Your Data is not intentionally accessible to other LYNQr subscribers.
6.4 No Sale of Data.
Link, Inc. does not sell Your Data to third parties. We do not use Your Data for advertising purposes. We may use aggregated, anonymized usage data to improve the Service and develop new features. We do not use your confidential project data to train shared AI models without your explicit consent.
6.5 Data Retention.
Upon cancellation of your subscription, your data will be retained for 90 days, after which it will be permanently deleted. You may request earlier deletion by contacting support@getlynqr.com.
6.6 Responsibility.
You are responsible for ensuring that any data you submit to the Service does not violate the rights of any third party, including intellectual property rights or confidentiality obligations.
6.7 Data Export.
You may request an export of Your Data at any time by contacting support@getlynqr.com. We will provide Your Data in a standard machine-readable format (such as CSV or JSON) within 30 calendar days of a valid request. We recommend exporting Your Data before cancelling your subscription or requesting account deletion. Link, Inc. is not obligated to provide data exports after Your Data has been permanently deleted in accordance with Section 6.5.
6.8 Data Breach Notification.
In the event of a confirmed security breach that results in unauthorized access to Your Data, Link, Inc. will notify affected users via the email address on file within 72 hours of confirming the breach. The notification will include, to the extent known at the time, the nature of the breach, the categories of data affected, and the steps Link, Inc. is taking in response. This commitment does not limit any other notification obligations that may apply under federal, state, or international law.
6.9 Inactive Account Policy.
LYNQr automatically removes inactive accounts to maintain the security and performance of the Service. The retention period for your account depends on your payment history:
6.10 Effect of Inactive Account Deletion.
When an account is deleted under this inactive account policy, all project data, property configurations, sync history, BIM Butler conversation logs, and any other data classified as Your Data under Section 6.1 will be permanently removed and cannot be recovered. Link, Inc. may retain anonymized and aggregated usage data, billing and transaction records required by law, and data necessary to resolve pending disputes or comply with legal processes.
6.11 Reactivation.
If you wish to continue using the Service after your subscription has lapsed, you may reactivate your account at any time before permanent deletion by logging in and renewing your subscription. Once your account has been permanently deleted, you will need to create a new account and your previous data will not be available.
7.1 LYNQr IP.
The Service, including all software, interfaces, logos, and documentation, is the property of Link, Inc. and is protected by applicable intellectual property laws. Nothing in these Terms grants you ownership of any part of the Service.
7.2 Feedback.
If you provide feedback or suggestions about the Service, you grant Link, Inc. the right to use that feedback without restriction or compensation to you.
The Service integrates with or depends on third-party services including Stripe (payment processing) and DigitalOcean (infrastructure hosting). Your use of these services is subject to their respective terms and privacy policies. Link, Inc. is not responsible for the acts or omissions of any third-party service provider.
LYNQr connects to third-party architectural design software including Graphisoft Archicad and other BIM platforms. Link, Inc. is not responsible for the performance, availability, or changes made by these software platforms, including updates or API changes that may affect the Service’s ability to connect to or extract data from such software. Interruptions to the Service caused by changes to third-party architectural software do not constitute a breach of these Terms.
LYNQr may offer a partner and referral program through which authorized partners earn commissions for referring new subscribers to the Service. Participation in the partner program is subject to a separate Partner Agreement between the partner and Link, Inc.
If you were referred to LYNQr by a partner, your subscription terms, pricing, and rights under these Terms of Service are not affected by the referral relationship. Partners do not have access to your account data, project data, or any information beyond what is necessary for commission tracking (specifically: whether a referral resulted in an active subscription and the number of active seats).
Link, Inc. reserves the right to modify, suspend, or discontinue the partner program at any time. Changes to the partner program do not affect your rights as a subscriber under these Terms.
LYNQr Pulse is a desktop application that runs on Windows. By installing and using Pulse, you acknowledge that:
LYNQr includes AI-assisted features, including BIM Butler, that provide conversational access to your project data. By using these features, you acknowledge and agree to the following:
LYNQr Pulse relies on Tapir, an open-source third-party integration maintained independently of LYNQr, and requires a supported version of Archicad to function. LYNQr supports the three most recent major releases of Archicad at any given time. LYNQr does not control, warrant, or guarantee the availability, accuracy, or performance of Tapir or Archicad, and is not responsible for sync failures, data loss, or errors caused by those applications or their updates.
To ensure reliable operation, you are responsible for:
LYNQr shall not be liable for any data inconsistencies, failed syncs, or service interruptions arising from unsupported software configurations, network instability, or third-party software behavior outside LYNQr’s control.
THE SERVICE EXTRACTS AND ORGANIZES DATA FROM ARCHITECTURAL DESIGN MODELS. OUTPUTS ARE PROVIDED FOR DESIGN MANAGEMENT AND PROJECT COORDINATION PURPOSES ONLY. LYNQR DATA OUTPUTS ARE NOT A SUBSTITUTE FOR PROFESSIONAL JUDGMENT AND MUST BE VERIFIED BY A QUALIFIED PROFESSIONAL BEFORE USE IN CONSTRUCTION, PROCUREMENT, CONTRACTOR BIDDING, OR ANY PURPOSE WHERE ACCURACY IS MATERIAL. LINK, INC. IS NOT RESPONSIBLE FOR DECISIONS MADE ON THE BASIS OF SERVICE OUTPUTS WITHOUT SUCH VERIFICATION.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. Link, Inc. does not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
Link, Inc. does not guarantee any specific level of uptime or availability for the Service. We will make reasonable efforts to maintain availability but do not commit to any service level agreement unless one is separately agreed to in writing. Scheduled and unscheduled maintenance may result in temporary unavailability.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LINK, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. IN NO EVENT SHALL LINK, INC.’S TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO LINK, INC. IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.
You agree to indemnify, defend, and hold harmless Link, Inc. and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
18.1 By You.
You may stop using the Service and cancel your subscription at any time.
18.2 By Us.
Link, Inc. may suspend or terminate your access to the Service at any time for violation of these Terms, non-payment, or any other reason, with or without notice.
18.3 Effect of Termination.
Upon termination, your right to use the Service ceases immediately. Sections 6.5, 6.7, 6.8, 6.9, 6.10, 6.11, 7, 10, 11, 12, 13, 14, 16, and 19 survive termination.
These Terms are governed by the laws of the State of Idaho, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Idaho, and you consent to the jurisdiction of such courts.
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.
These Terms, together with the Privacy Policy at getlynqr.com/privacy, constitute the entire agreement between you and Link, Inc. regarding the Service and supersede all prior and contemporaneous agreements, representations, or understandings, whether written or oral.
The failure of Link, Inc. to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of Link, Inc.
Certain features of the Service may be made available as early access, beta, or preview functionality. These features are provided as-is, may be incomplete, and may be modified, suspended, or discontinued at any time without notice. Early access features are not subject to the service level commitments or warranties described elsewhere in these Terms.
You may not assign or transfer your rights or obligations under these Terms without the prior written consent of Link, Inc. Link, Inc. may assign or transfer these Terms, in whole or in part, without restriction, including in connection with a merger, acquisition, or sale of assets. These Terms will be binding on any permitted assignee.
Link, Inc. shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, internet or infrastructure outages, actions of third-party service providers, or changes to third-party software platforms including architectural design software. In such events, Link, Inc.’s obligations will be suspended for the duration of the condition.
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms at getlynqr.com/terms and updating the Last Updated date. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
